State Privacy Rights & Notice at Collection

This page supplements our Privacy Policy with the specific disclosures required by California's CCPA/CPRA and by comparable laws in other states. It applies to SolarSaveAmerica, operated by Lead Cactus LLC.
1. Notice at Collection
This is what we collect at or before the point you give it to us, why, and whether it is sold or shared.

Sources. All of it comes either directly from you through the form, or automatically from your device at the moment you submit it. We do not buy personal information about you from data brokers and we do not append or enrich your record from outside sources.
Who receives it. Third-party marketing partners — solar installers, home improvement contractors, and lead networks that may pass your request to companies in their own networks. They are listed on our Marketing Partners page. We also use service providers (Cloudflare for hosting, LeadsPedia for lead distribution) that process data under contract and may not use it for their own purposes.
Retention. Five years from submission, then deletion. That period is set by the limitations period for telephone consumer protection claims — we must be able to demonstrate that consent was given. See section 4.
Automated decision-making. Which companies receive your request is decided by automated routing rules based on your ZIP code and answers. This produces no legal or similarly significant effect about you — it determines only who may contact you with an offer.
2. Your rights
Depending on your state of residence, you may have the right to:
- Know / access — what we collected about you, where it came from, why, and who received it
- Delete — ask us to delete what we hold, subject to the exception in section 4
- Correct — fix inaccurate information
- Opt out of sale and sharing — see Do Not Sell or Share My Personal Information
- Portability — receive a copy in a portable format
- Non-discrimination — we will not treat you worse for exercising any of these
- Appeal — challenge a decision we make on your request
These rights are grounded in the California Consumer Privacy Act as amended by the CPRA, the Virginia CDPA, the Colorado Privacy Act, the Connecticut CTDPA, the Utah UCPA, the Texas TDPSA, the Oregon OCPA, the Montana MCDPA, and comparable laws in other states as they take effect. Rather than track which rights apply in which state, we extend all of them to every U.S. resident. It is simpler for you and simpler for us.
3. How to make a request
Email info@leadcactus.com and tell us which right you are exercising. Clicking that link opens a pre-filled message.
Verification. To protect you, we must confirm you are who you say you are before acting on an access, deletion, or correction request. We do that by matching the name, email, phone, and street address you give us against what we hold. We use that information only to verify the request. If we cannot match it, we will tell you rather than guess.
Timing. We acknowledge within 10 business days and respond substantively within 45 calendar days. If we need more time we will tell you why and may extend by a further 45 days. Opt-out requests are honored within 15 business days and require no verification.
Authorized agents. An agent may act for you with your signed written permission. We may contact you to confirm.
Appeals. If we decline your request, reply to our response with "Appeal" and your reason. We will review and respond in writing within 45 days with our decision and reasoning. If we deny the appeal, you may contact your state attorney general. California residents may also contact the California Privacy Protection Agency.
4. One limit on deletion, stated plainly
If you ask us to delete your information, we will — with one exception. We keep the record of the consent you gave to be contacted: the timestamp, IP address, browser user agent, the page you submitted from, and the phone number the consent covered.
We keep it because telephone consumer protection law makes the business that placed a call responsible for proving consent existed, and the limitations period for those claims runs four years. If we deleted the record on request, we would destroy the only evidence that the call was authorized. Every applicable state privacy law permits retention for exactly this kind of legal-defense purpose.
That record is not sold, shared, used to market to you, or used for any purpose other than demonstrating consent if it is ever questioned. It is deleted five years after submission. Everything else we hold is deleted when you ask.
5. Financial incentives
We offer no financial incentive or price difference in exchange for personal information. Our service is free to you.
